The following disclaimers are made on behalf of Benmak Virtual Assistants, our affiliates, subsidiaries, successors, and assigns, and each of our respective officers, directors, employees, independent contractors, agents, and shareholders. They handle what is on not upon our shoulders concerning the access, use and reception of our Services. “Services” herein refers to all paid benefits you seek from us through our website (https://benmakva.com) or other access avenues related to us.

This Disclaimer document is subject to change, upon the sole discretion of Benmak Virtual Assistants. You are highly encouraged to keep checking for any updates and keep abreast of the changes.

  1. The Services are provided on an “as is” basis and without any warranty or condition, express, implied, or statutory. We do not guarantee and do not promise any specific results from the use of the Services, including the ability to provide or receive Services at any given location or time on demand basis.
  2. We do not warrant that your use of the Services will be accurate, complete, reliable, current, secure, uninterrupted, always available, or error-free, or will meet your requirements, or that any defects in the Services will be corrected. We disclaim liability for, and no warranty is made with respect to, connectivity and availability of the Services.
  3. To offer you the specific Services of Social Media Management, we will definitely need login details for your social media accounts. By granting us the permission to offer you these Services, you agree that you entrust us with your social media account(s) and their login details, and that no accusations will be made against us concerning access to your social media accounts during the time of receiving our Services. Giving access to other people to your social media platforms is your own decision, for which you are accountable, and any damages, deletions, losses, or posts that may be done by any other person with access to your social media platforms are not our responsibility, and we are not accountable for them.
  4. Please note that there are also risks of dealing with persons or people acting under false pretence, and we do not accept responsibility or liability for any content, communication, or other use or access of the Services by impersonators acting in violation of these Terms. In acting on any communication purporting to be from us, we encourage you to only act on communications from our official contacts, as clearly stipulated on our Contact Us page. It is upon you to conduct due diligence before committing yourself to a contractual agreement with us or anyone claiming to represent us.
  5. Benmak Virtual Assistants is not responsible for the conduct, whether online or offline, of any User of the Services. We are only responsible for content we share on behalf our Clients on their social media platforms in fulfillment of our delivery of Social Media Management Services, which is only done after their review and approval.
  6. Benmak Virtual Assistants expressly disclaims any liability arising from the unauthorized use of your User/Client account. Should you suspect that any unauthorized party may be using your User account or you suspect any other breach of security, you agree to notify us immediately. We strongly advise you to consider logging off from any shared device whenever you are not using our Services on that shared device.
  7. It is possible for others to obtain information about you that you provide, publish, or post to or through the Services (including any profile information you provide), send to other Users, or share during the Services, and to use such information to harass or harm you. We are not responsible for the use of any personal information that you disclose to other Users on or through the Services. Please carefully select the type of information that you post on or through the Services or release to others. We disclaim all liability, regardless of the form of action, for the acts or omissions of other Users (including unauthorized users or “hackers”).
  8. Opinions, advice, statements, offers, or other information or content concerning Benmak Virtual Assistants or made available through the Services, but not directly by us, are those of their respective authors and should not necessarily be relied upon. Such authors are solely responsible for such content. Under no circumstances will we be responsible for any loss or damage resulting from your reliance on information or other content posted by third parties, whether about the Services or otherwise.
  1. In the case of an overpayment, repeated payment or unprocessed payment, you agree that you will follow the process stipulated on our Refund Policy and or contact us for further guidelines. This process is set to take time, and you agree to be patient enough with the process and accept its dynamics.
  2. There is no guarantee whatsoever that you will be refunded, or that you will get the full amount of the refund in case of an overpayment, duplicated payments, cancellation of services, pausing of Services, or any other interruption of your use of our Services. Though we strive as much as we can to make the process as smooth as possible, we understand there may be transaction costs, other financial implications and delays, or even misunderstandings, which may derail the process. We advise for calm, understanding, and clarity of communication between Benmak Virtual Assistants and the User or Client throughout the process.
  3. Upon the review of a book, or editing of a manuscript, you agree that your name, book title and email address will be used when publishing the book review, among other basic details which we may ask from you. We are not responsible for any harm that may result from this, whether physical or psychological.
  1. If you had paid for a service, whether a one-off service or a long-term service, and then you terminate it, it may translate to the loss of your money for whose services you may not have received. We are not liable for any losses, financial or otherwise whatsoever, which may result from the cancellation of a service that was being delivered seamlessly.
  2. Our website, as clearly clarified in the Data Privacy Policy, is not a payment collecting platform but instead a platform for guiding you on how to make payments for the services therein. We disclaim any losses, intentional or unintentional, which may beget you during the payment process. All our payments are processed by the respective payment service providers for the payment service you choose to use.
  3. All transaction costs, and any other costs which may be incurred during the seeking, using or receiving of our Services is upon you as a User or Client. They are not part of our charges for the Services and may not be deemed as part of the costs or our Services.
  4. In case of copyright infringement or the violation of intellectual property laws caused by the Client’s impersonation, ignorance, pretense or lies, the Client is solely responsible for it. We strongly advise Clients to remain truthful in seeking our Services, sharing their basic contact details, literary works (such as books and manuscripts), and experiences with our Services.
  5. As clearly discussed on the Terms and Conditions document, Clients agree that at any point during the relationship with Benmak Virtual Assistants, and for a period of up to Six (6) months after, they may not approach any Assistants or Benmak Virtual Assistants Talents for any reason outside the normal course of day to day operations to perform Services for which Benmak Virtual Assistants Talent has been hired. Breaching this agreement is grievous, and you will be solely responsible for its consequences.
